Dying without a will

When someone dies, those left have to deal with the issue of what to do with their property and belongings. If there is no Will (i.e the estate is intestate), there is legislation that helps with the process of dividing any assets.

Here are the basic steps to follow:

  1. Check that there is definitely no Will to be found
  2. Apply for a Grant of Representation (often called probate )
  3. Pay any inheritance tax due
  4. Collect together any assets
  5. Pay any debts owed by the deceased
  6. Distribute the estate

How to Find Out if There is a Will?

It can be difficult to establish after their death if someone made a Will. It is therefore recommended that if you have made a Will, you tell your family that you have made one, and where it is held.

If you don t know the location of a deceased s Will, it is important to carry out a thorough search. Below are some ideas of where to look:

  • Check through the deceased s documents – most people have a file of important documents (birth certificates / insurance etc) somewhere, so it may be with those
  • Check in the deceased s safe
  • If they had a lawyer that they used for other matters (e.g divorce or property sale) check if they hold a Will for the deceased
  • Try calling local solicitor s to see if they hold a copy Will for the deceased

Note: Sometimes people make more than one Will, as they update or change how they wish their assets to be divided. If you find more than one Will, make sure that you use the most recently dated version, as older versions will no longer be valid.

Intestacy Laws

If there is no Will, then the distribution of the estate will be governed (in England and Wales) by the Administration of Estate Act 1925. These are commonly known as the laws of intestacy, someone who dies without a Will is legally called intestate.

Obtaining probate

Regardless of whether there is a Will or not, you will need to apply for a Grant of Representation (commonly called probate ). If there is no Will, the deceased s next of kin can apply for probate (for example their spouse, civil partner, or child). It is possible to apply for probate as the spouse or civil partner of the deceased, even if you are separated, as long as you are not divorced.

Note: Unmarried partners cannot automatically apply for probate, (nor will they inherit your assets under the law of intestacy), so if you have a long-term partner but are not married, it is especially important that you make a will.

If all assets were jointly held, technically you do not require probate to distribute them. However many organisations such as banks will still ask for a copy, so it may be worth doing anyway!

Applying for probate

Here s how to apply:

  1. Complete a probate application form (PA1). If you need help completing the form, call HMRC on 0300 123 1072
  2. Complete an inheritance tax form. (You must complete this form, even if you think no tax is owed.)
  3. Send both forms along with the death certificate, the original will and three copies (if a will exists), and a £125 application fee. (There is no fee is the total estate is worth under £5,000)
  4. Swear an oath at the office of a Commissioner for Oaths (eg a solicitor s office), or the local probate office

You should get the probate certificate through in the post within 10 working days of swearing your oath.

How Stop Someone Getting Probate

You can stop someone getting probate by entering a caveat, as long as you are aged 18 or over. This caveat lasts 6 months to enable any dispute to be resolved. To enter a caveat, fill in form PA8 and send a £20 fee. (We recommend consulting a solicitor or your local Citizen s Advice Bureau if entering a caveat, as usually, they precede a heated dispute between relatives.)

Find Out How an Estate Was Distributed

You can search probate records online for anyone who died after 1858. This should tell you who obtained probate to distribute the estate. There is a £10 fee per search. It takes around 14 days for the online record to update with details of new registrations.

Paying Inheritance Tax

You will have sent an Inheritance Tax Form to HMRC when obtaining probate, so they will let you know how much inheritance tax must be paid out of the deceased s assets. Just follow the instructions on the paperwork sent to you, and if you have any queries, contact HMRC who are usually very good at talking relatives through the process.

Collect the Deceased s Assets

If you send the probate certificate to organisations holding the deceased s assets (e.g banks), they should release these to you. You may also need to sell the deceased s property in order to release funds; any fees involved in the sale can be deducted from the sale profits.

To speed up the asset release process, you may wish to obtain several copies of the probate certificate. These cost only around 50p per copy.

Paying off debts

Before distributing the estate, the executor has a duty to pay off any debts owed by the deceased. This includes any outstanding tax owed to HMRC. Also don t forget that if the deceased didn’t have a funeral plan in place, you will need to deduct the funeral costs from the value of the estate; funeral costs can be several thousand pounds!

If you are the executor, place a notice in The Gazette to give any creditors a chance to come forwards before the estate is distributed. That will ensure that you hold no personal liability for any of the deceased s debts of which you may not have been aware.

Distribute the Estate

Jointly held assets:

  • Any money in a joint bank account will automatically pass to the other owner(s)
  • Any property owned under a joint tenancy (where all parties own the whole property jointly), will automatically pass to the surviving owner(s)
  • Any property owned under a tenancy in common (where each party owns a fixed share of the property), the deceased s share will pass according to their will or the law of intestacy

Assets not held jointly

If there is no will, you will need to distribute the estate in accordance with the law of intestacy:

Intestacy Law – Who Gets What If There s No Will?

If the estate is worth under £250,000, and the deceased has a spouse or civil partner, they will inherit the whole estate.

If the estate is worth over £250,000 the estate is divided as follows:

(1) Spouse or Civil Partner Still Alive

If the estate is worth over £250,000, and the deceased has a spouse or civil partner, they will inherit £250,000 value from the estate plus all personal possessions (regardless of value). The remainder of the estate (over £250,000 value) will then be split as 50% to the spouse or civil partner, and 50% divided between the surviving children. This includes adopted children but not step-children. If the children have died already, then their children will inherit in their place. If there are no children, the spouse or civil partner will inherit the whole estate.

(2) No Spouse or Civil Partner

If the deceased has no spouse or civil partner, the estate will be divided equally between their children. This includes adopted children but not step-children. If the children have died already, then their children will inherit in their place.

(3) No Spouse or Civil Partner and No Children/Grandchildren

If the deceased has no spouse or civil partner, and no children or grandchildren, the estate will be divided equally between their parents. If the deceased has no living parents, the estate will be divided equally between their brothers and sisters (or their children if they have already died).

(4) No Spouse, Children, Parents or Siblings

If the deceased has no spouse/civil partner, no children/grandchildren, no parents and siblings, the estate will be divided equally between their half brothers and sisters. If there are no half-siblings, the estate will be divided equally between their grandparents. If there are no living grandparents, the estate goes to aunts and uncles (half aunts and uncles if there are no full ones) or to their children (the deceased s cousins) if they have already died.

(5) None of the Above Relatives

If the deceased has no living: spouse; civil partner; children; grandchildren; parents; brothers or sisters; half brothers and sisters; grandparents; aunts and uncles or half aunts and uncles; nephew/nieces or cousins, the estate will all pass to the Crown.

Example Scenarios

Q] Joe has died with no will. He has a wife, a son, and two step-daughters. His estate is worth £350,000. Who inherits?

A] Joe s wife would receive £250,000 of the estate, plus any personal possessions (regardless of value). The remaining £100,000 of the estate would be divided equally between his wife and his son. Step-children are not recognised by the law of intestacy. His wife would therefore receive a total of £300,000 plus personal possessions, his son would receive £50,000 and his stepdaughters would receive nothing.

Q] Beth has died without a Will. She has no husband or civil partner, no children or grandchildren, and no parents or grandparents. Her only surviving family is the boyfriend she lives with, and her aunt who she hasn’t spoken to since she was a child. Who inherits?

A] Her aunt would inherit the entire estate. The law of intestacy doesn’t recognise unmarried partners. Her aunt is a recognised relative and so will inherit the estate, regardless of whether they are estranged.

As you can see from the above, it is extremely important to make a Will if you have step-children or an unmarried partner that you would want to inherit from you. If you don t have a Will, they won’t get anything unless assets are jointly held!

Some of Your Questions Answered

My wife s mother left her and her sister the house. The Will states that her unmarried partner is allowed to live in the house until he dies. Can they get him out as they would like to sell the house?

The unmarried partner has been given a life tenancy in the property. That gives him the right to remain in the property until his death. He will be responsible for all insurance and maintenance costs. You can t legally throw him out, so your choices are either to sell the estate subject to a life tenant (not usually very desirable to a buyer), or speak to him about him forfeiting his life tenancy (likely by you buying him out ).

My great aunt passed away hasn’t left a Will, my mother is her niece. She left invested money of over £30,000, plus valuable items. Suddenly her nephew wants to take over and has already taken jewellery, ornaments and has demanded that anything we took from the house for safekeeping be returned or he s phoning the police. We found out that when my aunt was alive his wife took her wedding/engagement rings…she was suffering from Alzheimer s. The nephew has walked away from the house (rented) leaving a neighbour to clear as it has to be empty in 2 weeks. What can we do to ensure nothing gets sold without our say so that we can things of sentimental value in the family?

Has the nephew applied for probate? If not, then it may be worth you doing so. If he does not have probate, then he is not entitled to divide up the estate.

In any event, the estate must be divided up according to the rules of intestacy. Follow through the steps above to see who would inherit – this will depend upon what other surviving relatives are in your family. If your great-aunt has no spouse / civil partner, no children/grandchildren/great-grandchildren, and no parents, then the estate should be divided up equally amongst their sisters and brothers. If they are no longer alive, their children (ie her nieces and nephews) will inherit in their place. If there was no will and the nephew (your uncle) is legitimately inheriting from the estate, I would expect that your mother should do so too.

My dad was diagnosed with dementia 18 months ago. My sister who d previously had no contact for years, obtained POA (knowing he s worth over 500.000). She put him in a nursing home and fixed up the house then moved in with her daughter. My sister and I are the only next of kin, he passed away 4 months ago with no Will. Should I have inherited any of his estates? What can I do at this stage?

Firstly, I would question whether any Power of Attorney was valid. It seems strange that your father would agree for an estranged daughter to make all decisions (including financial decisions) on his behalf. If your father had already been diagnosed with dementia prior to signing the Power of Attorney, he may have lacked mental capacity making it invalid.

Secondly, if your father had no will, his estate would pass to his family in accordance with the laws of intestacy. Check whether your sister obtained probate. If not, she does not have the authority to distribute the estate. If your father had no surviving spouse or civil partner, then the estate should have been divided equally between all his children. If there are just two children (you and your sister), then you should have received 50% of the value of the estate, including the property value. (This does not necessarily mean that your sister has to sell the property, but she should give you 50% of the value to essentially buy out your share.)

Hi, my father has died, with no Will , we think. My eldest brother has dealt with everything he has divided all the money between us all , but it doesn’t add up. My dad was mentally fine not confused and he told us what he had, is there any way we can find out without asking my brother as I am sure there was quite a bit more money than he has said and my father had paid for his own funeral?

Again, check whether your brother had obtained probate. If not, he had no authority to divide up the estate. If you don t want to ask him, you can search for probate records online, for a £10 fee.

If your brother did have probate, it will be difficult at this stage to determine the value of the estate (ie how much was in your dad s accounts), as they will now be £0 / closed. You may therefore have to ask your brother directly.

Remember that any debts, including outstanding tax and solicitor’s fees, will need to be paid out of the estate prior to distribution. Also, inheritance tax may have been paid. These could all reduce the value of the remaining estate to be divided up.

Seeking advice

Dealing with the distribution of assets following the death of a family member is always tricky, and can particularly bitter and emotional if a dispute arises. If you disagree with the way the estate has been distributed, speak to the Citizens Advice Bureau for free advice and (though it may be difficult), try to approach the matter in a calm manner. Sometimes it can also be helpful to ask a trusted family friend or other relative to mediate any dispute to try to reduce any heated arguments and ensure a satisfactory resolution for everyone involved.

  1. My Mum died suddenly in 2009, it was such a shock. She had no will and my Dad got everything. They were still married and living together but were going to separate and stay as friends in the same house, they were only together because they couldn’t afford to get there own place. Due to my Mum’s death my Dad’s behaviour went bad, he suffered from mental health and made my life hell. The police, counsellers and GP told me to leave for my own safety. I even rang up childline and they told me to go before he hurt me. The last time I seen him he put a knife in my face and told me to leave. I was so scared and had no where to go. I lived with friends and my Mum’s family for a few years until I started private renting, I find it hard to afford and I know it’s not what my Mum wanted. It doesn’t seem fair that my Dad got everything and I was left with nothing, it’s not what my Mum would have wanted, she would have wanted me to be safe and my Dad to look after me, but he is too dangerous. I am now 21, very depressed, have no money or savings and only a few family members and friends that help me. My Dad’s side have turned against me and we used to be so close. I really wish I could get help but I am scared, don’t have the money for a lawyer and don’t know where I stand to be honest. Would love someone to help me!

My mother died in 2012 leaving a will , only her half has been settled via Probate, but my fathers share is still held with the Solicitor. I understand we need a presumption of Death Certificate in order to settle my Fathers Estate. Can you tell me how this can be obtained and would my Mothers Will be upheld in this matter, or would dads share be allocated by the Courts as in other circumstances my Fathers Estate would have passed to my Mother.     @M.TM. Presumption of Death Act 2013 came into force on 1 October 2014. There have been some recent developments on this. The parliament.co.uk website describes it quite succinctly:
    “Presumption of Death Act 2013 came into force on 1 October 2014.The Act enables an application to be made to the High Court for a declaration that a missing person, who is thought to have died or who has not been known to be alive for at least seven years, is presumed dead. Once it can no longer be the subject of an appeal, the declaration will be conclusive as to the presumed death and effective for all purposes and against all persons. The missing person’s property will pass to others as if the missing person has died and been certified dead, and his or her marriage or civil partnership will end. Previously, people left behind by a missing person had to use various procedures to deal with different aspects of the missing person’s property and affairs.Anyone wishing to deal with a missing person’s property and affairs should seek specific legal advice based on all the particular circumstances of the case. Both Scotland and Northern Ireland have legislation governing the presumption of death: respectively the Presumption of Death (Scotland) Act 1977 and the Presumption of Death Act (Northern Ireland) 2009. Hi, can someone please help me, my mothers partner (not married) of 20 years sadly passed away and two weeks later my mother also sadly passed away, during the time they were together we very rarely saw my mothers partners family. And we were also told from the deceased that he had left a will as the estate was solely in his name, Since my mothers partner passed his family ransacked the home address which was also still my mums and my home at the time, they removed all paperwork including my mothers and also loose change and his laptop, they then told us he had left no will. About a year Before both passed away I moved in to the home address and now I am being told I have to leave as my mothers partners family wish to sell it. As a tenant do I now have rights? I have sent a standing search off as I believe there is a will out there but that could take 4 weeks and I’m being told they want me out now, so now not only have I lost my mother and a man who raised me and whom I classed as a father for 20 years but I am about to become homeless. No grant for representation has been authorised after looking on gov.uk nor have they put anything in the gazette. Also if my mum was still alive when her partner died would she not then inherit the estate or would they of had to of been married?

There have been many family meetings and the house was valued in January but still no concrete decisions being made.   17. My mother died of terminal cancer 7 years ago, my sister and i nursed her through her illness and i was the only one who was with her right at the end. My father is disabled and so we received a grant to cover the cost of most of the funeral which my sister and myself organised and my father did not attend. The wake was held at my ex husband’s place of work, my father never settled the bill so my ex eventually did and then witheld the amount from my maintenance. My brother (who went awol some 5 years earlier leaving his son in my mother’s care) turned up at the funeral with his new girlfriend who made a scene causing our relationship to break down. After the funeral, my brother (having refused my mother’s dying wish to see him), moved into my parents home with my father and has been allowed to dispose of all of my mothers possessions and family photo’s etc including furniture and other items that belonged to me. I have been left with 1 photograph of my mother and her engagement ring which she gave me shortly before she died. Her ashes are still in my father’s house, although my brother has taken them and hidden them in the past. I have requested just a small amount of them in the past but my father refused saying he wants my mother scattered with him at the other end of the country when he dies. Legally, do i have any rights? I don’t wish to be unreasonable but i do not have any contact with my father and if my mothers ashes are scattered in London, there is little chance of me and my children ever being able to afford to visit. My brother’s young son who was left in my mother’s care, came to live with me when he was 13 as my mother was unable to care for him. He has never paid me a penny maintenance or ever helped care for my sick mother or disabled father before the death of my mother yet now he is in charge of everything and we have been left with nothing.

    @Mez. Usually the spouse inherits, so there may be nothing untoward in her actions. If you feel your father’s wife has done anything unscrupulous you will need to see a solicitor.

    @cruttenden. Were none of the sibling in contact with the father at all? In general the next of kin is the spouse and generally they inherit, especially if there is no Will. You need to seek legal advice if you want to challenge this or investigate it further.

  26. We moved into my mums home 8 years ago, after my husband was ill. My mother has left a will for me to have the property worth £150.000. I oay her ‘life’ mortgage for her. She has now gone into a nursing home and is 86. The Social services have discounted house for her care costs because we are over 65. Will I have to sell the house on her death, for probate? Only the house is her estate

    @wills. If there was no formal separation the partner can still inherit part of the estate and any children of the partnership…you should contact a solicitor for information on how the estate was split.

    Generally he might be considered as a surviving spouse. Was there any documentation/financial arrangment etc at the time of the separation? Usually the surviving spouse takes the personal “chattels”plus a statutory legacy of £250,000 from the estate, plus half of any remaining balance. The surviving children or descendants equally share the other half of the remaining estate. You will need to ask a solicitor for advice really.

A couple of weeks ago my dads mum passed away, although i believe there is a will i’m not 100% sure if this was changed at some point when my father passed away, so i’m assuming the will was the same. Would my mother still be entitled to some of the estate, although there are surviving brothers of my dad? Also if my dads brother passed away and there is no will, ( he isn’t married and has no children of his own) how would his estate be broken up, i.e would it go to his surviving brothers, or would it go to his brothers children and the grandchildren.

    See a solicitor. Where someone dies intestate (with no Will), there are usually priorities in terms of inheritance where there is no surviving spouse.
    1. Children or their descendants
    2. Parents
    3. Brothers or sisters or their descendants
    4. Half siblings or their descendants
    5. Grandparents
    6. Uncles and/or aunts or their descendants
    7. Half uncles and/or aunts or their descendants
    8. Whole estate passes to the crown
    So as children, the estate should have been divided among you.

    Usually if a person dies intestate the main part of the estate goes to the spouse. To lodge a claim, the new partner would have take it to the courts. If they have a joint mortgage, this will of course be different.

Unfortunately my father had become frail and my stepmother had started with dementia so I suspect this was engineered by the stepsisters.     Yes the rules of inheritance where there is no Will, state that an estate would be shared equally between the children or their descendants. If a son or daughter has already died, their children (the grandchildren of the deceased) inherit in their place.

    This really depends on the Will, so we cannot really comment. In general if there is no Will available the order of priority of inheritance is generally:
    Spouse or civil partner
    Children
    Grandchildren & Great Grandchildren
    Other close relatives

    The insurance money will go to whoever was named as a beneficiary in the policy. Depending on the terms of the will, the rest of the estate would be split between the spouse and children etc. See this page for more information

    You were entitled to your share when the estate was first administered. Speak to a solicitor and find out how many years the remaining sum must be kept (usually between 12 and 30 years) before being divided between the two of you.

    No you do not inherit an estate simply because you have power of attorney. If there is no Will, the estate will go through probate and will be split according to the rules of inheritance as detailed above.

    The usual means of finding a will are via the deceased’s own paperwork, their solicitor (or local solicitors if you do not know whether they had one), their bank or the London Probate Department. (If there is a property, a reasonable sum of money or pensions etc involved then the estate would have gone through probate)

    Do you have a trusted friend or family member who can help? There is a lot of information the internet about what to do but it might be easier for you to ring Citizens’ Advice. They will ask you what information you have and probably make an appointment for you to take the paperwork and they’ll help you sort out any paperwork and advise you on how to arrange the funeral etc.

    Check all wife’s paperwork at home. It would be strange if a husband did not know about a will made by a spouse but if he doesn’t find a copy in the home he could check around local solicitor firms in the area in which he lives. As for the banks if they’re joint accounts he will know which ones they are. Any other banks – he could try writing to with a copy of the death certificate asking if they have information of any accounts she held. To seek further information about a Will if he gets nowhere with solicitors or banks, he could also check companies that offer the storage of wills – search via the London Probate department.

    No, do not automatically sign anything or decide to use this firm especially if they will not tell you the size of the inheritance.     You will have to see a solicitor about this. The usual rules of intestacy state that the estate is shared between the children. Where the one of the children has died, the grandchildren inherit.

    Usually, the estate would have passed to your stepfather when your mother died. Unless specified otherwise the estate would normally go to any natural (or adopted) children of the stepfather.

    If he didn’t make a Will, the usual rules of intestacy will apply. If there are surviving children, grandchildren or great grandchildren of the person who died and the estate is valued at more than £250,000, your step-mother-law will inherit all the personal property and belongings plus the first £250,000 of the estate, and half of the remaining estate.

    No, the rules of intestacy mean that any estate should be shared between children if the other parent has died. You might need to see a solicitor to pusue this.

    No it is unlikely that you would…your stepfather is now the property owner and if he dies intestate his estate will go to his spouse and any natural children.

    If your mother did not make a Will then the rules of intestacy state that where an estate is valued at over £250,000, the husband keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value. The rest of the estate is then shared as follows:
    Your step father receives half of the remainder
    the other half is then divided equally between the surviving biological children.
    If there is a Will and you want to contest it, you must do so via the usual means. Please note it is quite normal for a spouse to be given power of attorney over the other spouse’s affairs once dementia or alzheimers renders then incapable of managing them themselves.

    She shouldn’t have taken any of the possessions from the house until the estate has been through probate. Contact a solicitor for advice.

When I was nearly one they bought the house I grew up in, deposit paid for by savings accrued by my mom and dad who both worked full-time.     If she sold the house to your sister, then it now belongs to your sister and doesn’t form part of your mother’s estate. Any funds, assets (if she bought a different property) etc should be split equally between the five of you.

    If you can prove that the separation took place and when, that may help you to contest it, also if you have the draft Will your father wrote, it may be taken account of if it can be verified. Under automatic inheritance (if person dies intestate) rules the surviving married partner will take all of the first £250,000 and plus half of the remainder, the children get half of anything above £250,000.

    We don’t have details of who the next of kin was etc. In general ashes will only be released to the funeral director or a named person who has to provide identification. Most crematoria will only keep ashes for 30 days so, it does seem a bit late in the day for auntie to be taking an interest.

    Scottish laws of succession suggest that the spouse or civil partner inherit property where this is no Will and half of the “moveable” estate. Take a look at this Scottish government document. It’s definitely worth seeking legal advice before you proceed.

    Under the usual rules of inheritance, where there is no Will, the estate will be divided equally between you and your remaining siblings. Because your brother has died, his share will go to his two children. Until probate has been granted, nothing should be taken/removed from the estate. Your first step should be to apply for probate (via a solicitor is often the best option). Here is some more infomation about probate. Send a copy of the death certificates to your parents’ bank so that no further money can be withdrawn.

    We really think you should seek legal advice on this, as you’ve carried on paying the mortgage yourself for the past 6 years it may be that you could argue you have more right to it.

    As they were not officially married, your father’s estate will naturally pass to his children under the laws of inheritance. You may have to use the services of a solicitor to make sure the correct people inherit. If you think there might be a Will, try his bank, local solicitors, a search of the house etc.

    You can contest a Will as a potential beneficiary up to 12 years after the death. Bear in mind however, that after 8 years, it’s likely that all the assets will have been disposed off, so there may be little remaining of the estate.

    Yes – make sure you have the Will witnessed by two indendent witnesses. When you say “I direct my Executor to divide the residue of my estate to my parents” – that suggests that part of your Will is going somewhere else – or is it simply after funeral costs/debts are taken out? It’s worth getting it looked over for legality etc.

    Under UK rules if there is no Will and the estate is valued at more than £250,000, the wife will inherit all the personal property and belongings of and the first £250,000 of the estate, and half of the remaining estate. So you as the only child would get the other half of the remaining estate.

    If there is no Will If the children inherit the whole estate, so your mother was rightly left everything. What she decides to do with the money is up to her. If she decdided to transder it to your account to fraudulently claim benefits you could either refuse to keep it or contact the fraud department at the DWP/Job centre…whichever benefit she is trying to claim.

    If you ahve a copy of the death certificate you should be able to apply for a COPY of the title deeds.

    There are several grounds under which you can contest a Will such as if the deceased was of unsound mind or heavily influenced when making the Will. If you are a dependent child you will find it easier to contest a Will than as an adult. You should contact a legal professional for advice.

From the very beginning I asked her if there was anything at all she wanted, she was more than welcome. I did go about this respectively honoring thier bond. But I began to get a feeling she wasn’t honest with me. And this is where it all gets more painful, on top of the grieving. Turns out she did confess to taking his arts and crafts, cell phone stating these items were meaningful to her. Now I asked her numerous times let me know whatever it is you want. Never a reply. Well I haven’t heard from her and I know she is grieving his loss but he was my only brother, my blood. I tried to explain to her that this should have been done the right way by allowing me to gather his belongings.This has caused me even more pain in my heart . I trusted her. And she like has just denied me of who I am. She also denied me the pleasure of giving these things to her. By the way this can also mess with someones head while grieving a deep loss.     Ordinarily, if there was no Will or spouse, the estate would be divided equally between the siblings. If you want to challenge that you should take the evidence you have to a solicitor

    The expenses you incurred for the funeral etc, can be taken out of the estate. You could try contesting it but unless you have evidence (receipts etc) of the money you spent in caring for your mother, it’s unlikely to succeed.

    Depending on the value of the estate the rules are that: The husband, wife or civil partner keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value. The remainder of the estate will be shared as follows:
    the husband, wife or civil partner gets an absolute interest in half of the remainder
    the other half is then divided equally between the surviving children
    If a son or daughter (or other child where the deceased had a parental role) has already died, their children will inherit in their place.

    Seek advice from a solicitor – if there was no Will, an ‘administrator’ would have dealt with the estate. A grant of representation to be the administrator of the estate can be given to the deceased’s next of kin, such as a spouse or child. You should be able to see how the estate was administered via the local probate registry

    The surviving children inherit before the grandchildren. If the estate is being divided amongst the children it’s up to them to divide the personal possessions eqally among themselves. Was there a reason your mother should have got the medals in preference to her brother? If not, there’s not much you can do about it.

    We suggest you seek advice from a solicitor. Under the usual rules of inheritance where there is no Will, if there are parents or children/grandchildren of the deceased, the estate is split between any surviving brothers and sisters.

    if there was no will and the estate was worth more than £250,000 – the inheritancy rules are as follows:
    The widow keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value.
    The remainder of the estate is shared as follows:
    The widow gets an absolute interest in half of the remainder
    The other half is then divided equally between the surviving children
    If a son or daughter (or other child where the deceased had a parental role) has already died, their children will inherit in their place.

Other than the aforementioned insurance policy & balance of cash from my fathers bank account (current), little else of value exists, with fathers effects & house content having been donated to a hospice charity subsequent to my sisters approval & her own removal of certain electrical goods. My fathers remains have yet to be interred, meaning additional costs will therefore be incurred at some point in the near future to facilitate financing the final burial procedure, I would therefore submit that any final closure of my fathers affairs & finances may necessitate a contribution from myself to supplement a projected shortfall of monies currently available from fathers estate.     You will need to see a solicitor about this if your sister has not followed the correct procedure. Usually someone will be nominated to administer the estate. Everything will be valued and then probate will have to be applied for from your nearest Probate Registry Office.

    Perhaps the house was already in joint names? There’s not really enough information here to comment. Is there some reason why after 10 years you are looking into this?

    If there was no Will the estate should be shared equally between all the children. Seek advice from a solicitor if this has not happened.

    If there is no Will the estate is divided as follows:
    If the estate is worth over £250000:
    The wife keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value. The remainder of the estate will be shared as follows: the wife gets an absolute interest in half of the remainder and the other half is then divided equally between the surviving children.
    If the estate is worth less than £250000 then the wife will get the whole of the estate.

    Yes if you’re making the payments on the house, make sure you have a written agreement and proof of the payments etc. It’s also worth asking your father in law to include details in his Will. He could also add his son’s name as a ”joint tenant’ on the property – that way the property will automatically go to his son if he dies.

    It’s worth consulting a solicitor over this. If there was no Will the estate often has to go through the probate process if it’s large enough. General inheritance rules are that the estate is divided equally between the children if there is no spouse.

Hello, I have a situation where a Will leaves a 1/3 share of the ‘residual estate’ to a party in a Trust (the other 2/3 shares left to others in the Trust) and the person who wrote the will dies in 1974. According to the Will, Another person is allowed to live in the House for the remainder of their lifetime thereupon it will be returned to the Trust. That person died in 1989 but no one seems to have checked the original will and there appears to have been no probate. The house has been sold and the Trust was never credited with the proceeds or informed of the sale. Given the number of years past, and the fact that whoever sold the house is now also deceased, is there likely to be any remedy?     There is no real legal definition of “next of kin” in the UK. It’s usually the closest blood relative or spouse. So you would usually name a spouse if you were married, a parent if you were a child and a sibling if you had no grown up children/surviving parents etc. Your brother would probably name his grown up children as next of kin in the absence of his mother.

    You should try and check this with a solicitor, if you are now adult (i.e not dependent) and your mother and step father were still officially married it may be that most of the estate goes to him as the spouse.

    You should seek professional legal advice on this. Ordinarily a parents’ property would be split equally between the children but as the house was effectively already owned by one of them, that may not be included in the estate.

    This sounds like fraudulent activity on your brother’s part unless he legitimately “bought” the house from your mother. Your mother will be asked questions about her finances to pay for a care home. Check with the land registry – they will have details about changes on the title deeds (your mothe will have had to sign etc). Seek legal advice to pursue it via the courts if you feel something has been done dishonestly.

My son just came in contact with his father 6: month’s before this accident. I did not know that he stayed with my son’s exwife, the next morning he did not show up and would not answer my calls or text. I Called for the release date from the coroner’s office, and I was told that my son was already released, and they could not tell me anything else. My son’s dad after making arrangements with me our son’s mother went to court with our son’s exwife, and got a Judgement to take my son form coroner’s behind my back, the judge assumed that they were mother and father. When I became aware of this wonderful news, I filed and went to court when the judge realized that he had ruled incorrectly, he still refused to change his ruling. I have taken this to the higher Court in Riverside CA, the judge and father did nit respond. I’ve been waiting since last February for a decision. I used all of my bereavement time from work in and out of court, I haven’t been able to morn the loss of my son. I never got to see my son after the accident, his grandmother, and aunts, niece’s and nephews, friend, the entire Family never got to see him. I am devastated. Who can help me, what can I do. His father and his exwife Penalty upon perjury on the court, the judge didn’t confirm that who was in front of him was mother and father, because if they were, why on earth would they go to court for a Judgement, all they would have to do is go to the coroner’s office.     The estate is shared equally between any children or their descendents. So as your sister has already died, her children will receive her share. You can choose who you want to administer the estate. A solicitor will be able to advise you on this.

    If there is no Will and the property and assets are valued at more than £250,000, the rules of inheritance state that her husband will keep all the assets (including property), up to the value of £250,000, and all the personal possessions, whatever their value. The remainder of the estate will be shared as follows: the husband, wife or civil partner gets an absolute interest in half of the remainder the other half is then divided equally between the surviving children. You may need to seek legal advice if you feel the husband has not gone through the probate procedure etc.

    If the property was in his friend’s name your father wouldn’t be in position to leave that to anyone as it didn’t officially belong to him. If he left a Will that was recognised by the legal system, then his other possessions/money will go to those named in the Will. If there was no Will, any other possessions/money belonging to him would automatically go to a spouse/civil partner, if there is no spouse or civil partner they go to the children.

    Yes the normal inheritance rules state that the spouse keeps all the assets (including property), up to £250,000, and all the personal possessions, whatever their value. The remainder of the estate will be shared as follows: the husband, wife or civil partner gets an absolute interest in half of the remainder and the other half is then divided equally between the surviving children. As you are not the children of your mother’s new partner obviously this will not relate to you. You mother might want to think about writing a Will if she wants to protect any of what you consider to be your inheritance.

    If there is no Will the natural rules of inheritancy say that the estate is sharing equally between the children of the deceased (or their children if they have already died).

    If an estate valued at less than £250,000 and there is no Will, the entire estate passes to the spouse. This means that your father would have inherited his wife’s estate at the time of her death and you as his offspring will inherit now he has died. You should check with a solicitor to make sure that no Will is still in the process of adminstration etc.

    You could try local solicitors or banks to see whether a Will is registered there. Are there any other relatives or friends who might have witnessed the Will?

    If you’re not married and his name is not on the title deeds, your partner will not automatically inherit any of the estate. You should write a Will to ensure you wishes are fulfilled.

    As there is no Will you will have to go probate. First you need to apply to the court for a grant of representation. Your can do this yourself or ask a solicitor to help. Once you’ve completed the probate application form (you can find it here here , you then have to set about establishing the value of the assets, such as money from the sale of the house, in bank accounts, insurance policies, savings accounts etc. You then need to pay any debts (outstanding bills etc). Once you’ve done that you can divide and distribute the estate equally between you and your siblings.

    As one of the children, she is entitled to an equal share of the property. Did you father not have life insurance to cover the mortgage payments? This is often a condition that mortgage providers will stipulate. If you didn’t want your sister to have an equal share of the property, you would need to apply to the courts with evidence of the monies you have paid if you want a larger share of the inheritance.

    When the husband died his estate would have gone to his wife. Once she dies, her estate then goes to her parents if they are still alive or her siblings if the parents have died.

  331. QUESTION – My sister sadly died in April this year., and did not leave a will. She did not have children nor a partner. My mother has survived her. I will take the emotions out of this as a result of one of her sister’s unacceptable behaviour during my sister’s illness and after her death.. We initially gained access to the property when we found out that that sister was not stayng at the property. What we saw was shocking as the house had been turned upside down and the only places that you could walk through were the toilet and bathroom. However, the next day she had the locks changed, after, we believe, being tipped off by a neighbour of my late sister. That sister, who was my late sister’s next of kin during her treatment at the hospital states that states will be residing at my late sister’s house and will not leave until she sells her own home. (When I last passed her house there was no “for sale” sign at the property.). She claims she has been living with my sister since November 2015 and became her fulltime carer in April 2016. Please note that my late sister became ill on Boxing Day 2015, whilst visiting that sister’s house.     If there is no Will, the estate will normally go through probate. Your brother will have had to apply for a “grant of representation” and there will be a record of this. If the estate did not include any shares, land or property, he may not have needed to apply for probate, in this case there is not much you can do to find out how much was involved.

    If there are no children or parents, the estate naturally goes to siblings of the deceased. If the siblings have already died, the offspring of the siblings inherit in their place.

    This depends on whether he wrote a Will or not. In the absence of a Will, most of your father’s estate will have passed to his spouse.

What happen if a couple did not marriage but they have a registered child. After They spit. Father dies. No will. Siblings get everything ??? And if after this siblings die as well ? No children, no grandparents, no partner. But no contact as well, they don’t keep the contact with they nephew. Usually I don’t keep a close contact with my ex, he sometimes visit me and the child, shortly, but this is everything. I think, he doesn’t want will, but with cancer he won’t live very long….if he dies, does the authorities investigate, does he have a child or not ???     We’re sorry, we can’t give individual advice like this. You might be better asking at Citizens Advice. There are some things you could ask yourself like – How many years will you knock off the debt if you pay back more now? Could you use some of the money to reduce the debt and also have a holiday? etc

    Unless your ex has written a Will to the contrary, most of his estate will automatically go to a spouse (has to be a marriage), if there is no spouse the estate is divided between his natural children.

    When your mother died – if there was no Will and the value of the estate was worth more than £250,000 – your father would have kept all the assets (including property), up to that value (£250,000), and all the personal possessions, whatever their value. He would also have received half the the remainder of the estate and the half of the remainder would be shared equally between the children. If the estate had been worth less than £250,000 your father would have received it all and you wouldn’t be entitled to anything.

    If a child dies any property or possessions will usually go to the parents unless other beneficiaries are named on trusts etc. You should check this with a solicitor.

    If there is no Will and the deceased has no spouse, children, grandchildren or parents, the estate will be divided equally between their brothers and sisters (or their children if they have already died). So if your mother’s name is on the deeds she will get the property and, assuming there are no other brothers or sisters she will also inherit any other possessions etc.

    If the estate is worth more than £250,000, his wife will inherit £250,000 value from the estate plus all personal possessions (regardless of value). The remainder of the estate (over £250,000 value) will then be split as 50% to the wife and 50% divided between the surviving biological children. If there is a Will, obviously this will not apply.

    Who has the title deeds to the grave? If your father’s wife owns the deeds, her children can bury her there. You may need to seek professional legal advice to try and prevent this.

    If he left a Will then unfortunately you may have to accept the terms of the Will. If there is no Will and the estate is worth over £250,000, your father’s wife will inherit £250,000 value from the estate plus all personal possessions (regardless of value). Note if the property was owned as joint tenants it will not have formed part of your father’s estate and would automatically go to his wife.The remainder of the estate (over £250,000 value) will then be split as 50% to the mother and 50% divided between the surviving children (which we imagine will include you as a the biological children)

    Speak to your brother first, ask if you can be added as a signatory on the accounts etc. This will establish whether he’s simply doing what he thinks best in order to settle the estate, divide the assets etc. If you’re unsure, speak to a solicitor.

In the building Society she had just over 11,000 pounds that I was unaware of apparently it was an insurance that my late stepfather had paid in.     You’re second suggestion is correct. See point 3 in the above article “If the deceased has no spouse or civil partner, and no children or grand-children, the estate will be divided equally between their parents. If the deceased has no living parents, the estate will be divided equally between their brothers and sisters (or their children if they have already died).”

I have been advised this is not correct and that the estate should be split 2 ways – her deceased siblings each getting 50%. The 50% would then be divided between the number of children each of her siblings had. One sibling had three children and the other five. The advice I’ve been given is that for the three children they would receive 1/6th of the estate each and for the five children they would receive 1/10th of the estate.

    The advice you’ve been given is correct. As the above article states: “If there is no Will and the deceased has no spouse or civil partner, and no children or grand-children, the estate will be divided equally between their parents. If the deceased has no living parents, the estate will be divided equally between their brothers and sisters (or their children if they have already died).”
    So your aunt’s two siblings would get equal shares…50% each. As both siblings have died their share is divided equally between the children. So….if one sibling had three children, those children get 50% of the estate (i.e shared three ways). The other sibling had five children so theirs is the other half of the estate shared five ways.

    My grandmother passed leaving me a small amount of money I recently found out she had 3 life insurance policies and my aunt who knew took all the documents after her death giving us all a small about added up to just over 5000 between 5 of us now 6 months later she buys a new house and her son a new car,i just found out today that my gran had these life insurance policies and the money that was paid to us was by cheque from my aunt account she said she was instructed to give us this not mentioning the life insurance which at least one policy was 50 000 pounds what can I do im not concerned about the money at this point I just wanna know what happened for the sake of closure and that my grans last wishes were what they were.

    You’d have to check with a legal professional but we think that if there are no other blood relatives an estate can pass to the children of a half blood sibling.

    Can you get your brother’s part of the inheritance put aside for the future in case he is found? It might be worth seeking advice from a solicitor…adverts could be placed in various publications to see if he can be traced. It’s unreasonable not to try and trace him merely because you’re concerned about the effect the inheritance may have on him.

    If the deceased has no living: spouse; civil partner; children; grandchildren; parents; brothers or sisters; half brothers and sisters; grandparents; aunts and uncles or half aunts and uncles; nephew/nieces or cousins, then yes, the estate will all pass to the Crown.

If the UK property is a council property we assume it’s rented? You should therefore contact the council about clearing the flat (it’s likely you will need to present a death certificate).

    Tell your daughter to talk to her landlord and to get the tenancy put in her name alone. The deceased’s parents will then at least need her permission to access any of his property. She could try legal action to see if she can be given part of his estate.

    If there is no Will and no surviving spouse, the estate would usually go to any bioligical children. Ask Citizens’ Advice or a solicitor to look into this for you if you feel you may have a claim on the estate. If you brother said she left everything to him, this should have been in the form of a Will.

    Did your father have a Will? Is your aunt named as executor? If so, she can administer the Will. Why would it cause a problem if the money is to be divided between you and your brothers anyway? If there’s no Will any proceeds remaining after funeral costs are split between surviving children, so even if there’s no Will the same thing will happen.

    Unfortunately if you can’t use your powers of persuasion, the only other way to get your sibling to move out would be to apply to the court for an “order of sale”. If you simply want access to the property for funds to cover initial expenses, such as funeral, legal fees etc, then you might need to speak with a solicitor.

    If there was no Will and your grandmother’s name was the on the deed as a joint tenant, she would automatically have inherited the property and the remainder of the estate would potentially be split as described above. If your grandmother made a Will to decide who to leave the property to there is not much you can do about it.

    If he’s not on the birth certificate it would be hard for him to prove that he is a biological child if he even knows about his father. A DNA test to establish a relationship with you as siblings might be needed if he decided to make a claim to part of the inheritance. Seek advice from a lawyer to find out whether you need to do anything as you’re in possession of this knowledge.

  418. My brother in law has recently passed. So far as we know he had no will and had an decree nisi in place but no absolute. He moved into his parents house who have been caring for him for the past 3 years, he has not seen his wife. The solicitor has now said that she will get all of his money, pension and possessions. We have phoned the social who also say she would be entitled to a bereavement payment lump sum of £2.5k and a monthly bereavement allowance of £100 for however long. They were known to adult services in Hampshire in england and both died in a care home with a few months of each other and very frail and elderly and both had some level of confusion and dementia. They have a surviving daughter in her late 60s and grandson in the care of mental health services but i know not where. As far as I can tell – my uncle refused to set up power of attorney, consent to share or make a will. The nursing home know of no power of attorney or will in the papers they have belonging to my uncle after my aunt died. Social services will not confirm either way to me if they had set up power of attorney or a will with a solicitor – there is a bag of papers at the care home but the care home have stated they are not willing to do anything more with regard to this. They did organise the funeral as there was a funeral plan in my uncles papers. Although I have reported the situation to social services – they will not give me any information on if they know if power of attorney with a solicitor was set up however, the adult services team and the housing association did empty all the possessions at my uncles house early this year when he was admitted to the care home without informing me – though they had my details as niece. I am not sure what else to do at this point as I don’t know what is meant to happen next in England (I live in Scotland). I believe they had savings or money in bank accounts according to their previous neighbours which while not huge is still a tidy sum and should really got to the daughter and grandson Can anyone advise me on this?

    If a solicitor has advised that there is no probate required, we assume the value of the estate is low. If the estate is worth under £250,000, and the deceased has a spouse or civil partner, they will inherit the whole estate.

    Probate is usually needed if the estate is small – but usually if an estate contains property or has a value of more than £5000, it won’t be considered a small estate, so probate may be needed. If there are likely to be debts arising from the death, you should seek professional help. You should also check that there were no insurance policies in place that might help to pay off the mortgage debt.

    My dad died no will debt and no money at all had a taxi business cars repossessed as no money to pay off debts. A tax return has come to me for my deceased dad saying I am representative I haven’t put myself forward for this so am I automatically a representative as I signed death certificate. There is nothing in his estate he died with debt and no assets. I am not applying for probate as can’t afford to pay any charges as I am on limited budget personally. Any advice please help.

    If the value of the estate is not enough to cover the debts, the estate is ‘insolvent’. Whoever is the estate’s executor it is important to seek advice from a legal professional as debts will have to be prioritised and creditors informed. If this isn’t done properly you (as the executor) may be liable for the debts.

    Not really. If your parents both suffer from dementia, do you or your siblings hold power of attorney? You could at least ensure that any money spent on social care was spend wisely.

One sister was administrator and has received £100,000 of my father’s money, money because he died whilst still working for the local authority and money from bank accounts etc. 2 years on and this has not moved forwards. We do not know what has happened to that money. Another sister has taken her to court on our behalf to remove her as administrator which was successful. The court ordered she handed over all the originals of paperwork she has but instead she has handed over copies. She is now not responding at all. There is a property to be sold. She has allowed to people to live in this property who are paying rent. She has listed the address as a business. What can we do to move this forwards and bring it to a conclusion? How can she get away with this? I would really appreciate your advice.

    Where there is no Will, the next of kin applies to become a “Personal Representative”. This means that she gets Grant of Representation and will administer the estate; pay of any debts owed by your dad’s estate then sell property etc so that the money can be divided between those who inherit under intestacy rules (you and your siblings). Ask her why she has changed the property deeds into her name (seek legal advice on this if necessary)

    Yes if there is no Will, and there is no living spouse, no children or grandchildren and no living parents, the estate will be divided equally between their brothers and sisters (or their children if they have already died).

    You need to seek professional legal advice on this matter unfortunately. The children my be able to contest the Will if they were excluded from it.

The problem is that my mom and dad raised my sister’s children, the oldest niece was only 16 when mom was diagnosed with alziemers and at that time mom decided to give us 4 biological siblings something that she loved in the house and wanted us to have (We were all married and on our own at the time). The price is what myself, my daughter or anyone CAN afford & if we knew price was lowered, it would be my daughters. I do know how important it is to her & was to her dad. The Step mom will not consider my daughters posession. Her father DID NOT leave a will, or as said, life insurance. My question, can my daughter legally claim car or purchase it? My father brought £40,000 into their marriage and they bought a house in 2002, but his name is not on the title deeds, only the wife. He told me that money will come to me and my sibling only. The day after my dad was buried the wife and her daughter said my dad was broke and had no money. His step-daughter cut me out of the Executor process, so I have no knowledge of what has happened. The step-daughter emailed me an abusive message, after I asked for a copy of the Will, as they initially refused to hand it over. My father lived in the house for 17 years and contributed towards bills etc. The wife is talking like if he lived there as a lodger. Is he not entitled to a share of the house? My father is passing away at any moment now he made my brother Power of attorney now my dad has over $100,000 in the bank and that money keeps growing they’re not spending a lot of money on nurses as my brothers wife is taking care of my father so hardly any money is taken out of my dad’s account now my question is if my dad does not have a will which my brother says he does not does my brother have to split all the money between me and my sister and if he doesn’t share or be equal about it how do you go about making it right

  495. My dad just died on 10~17~20 and his ex girlfriend took possession of his house key and keys to the 2 trucks he owns. He just bought a 2012 truck the day he had a stroke and was transported to the hospital she took it all of his possessions including his wallet that contained his ID, social security card, and debit card to his checking account. I am his only child so what are my rights and my dad had no will I’m just wondering did I inheritate all of my dad’s assets and what do I need to be able to get all of his assets.

  496. My father passed away Oct 13th 2019 and he had no will his house went into foreclosure there is no personal representative or Executor, there is now surplus funds left over from his house who gets that money

  497. My Brother passed away in July 2020 after and accident, he has no will and was not married to his long term partner. He has three children all now adults) from a previous relationship and marriage. I am trying to ensure his insurance is paid equally to the children but all three of them only have mini birth certificates (i.e. no parents are named on them. However two of them are married and have their fathers name on the marriage certificate. Sadly the eldest is not married so applied for a full birth certificate again her Dads name is not on the certificate. How can we evidence that my brother was her father, we all know it to be a fact but the insurance require evidence?

Hi my grandma is going to a care home after breaking her hip, she doesn’t have any property and has no will , as we thought mum being the only sibling that she would be next of kin , but what we have been reading up, mum has no entitlement with the money side of things, grandma does have a bit off money in the bank, she is very confused at the moment, but said she wants mum to be power of attorney, just with her condition now , we don’t know where my mum stands and with covid going on this is making it harder for us to get someone to come to the care home ( were I work btw) to be a witness, we are so upset and confused

  499. Hi, Basically my nan passed away when I was about 8 years old I’m not 20 my grandad passed away roughly about 4 years ago. He met a lady who he never married or got engaged to, however he was with her for about 6 years. She sold the house and checked all the things out of the house after saying to my mum she could go round and get things if she wanted to, they arranged a date and by then the stuff had already gone out the house (after the funeral)… the funeral was all about my grandads years with her and not my nan… he didn’t leave a will. But always said if he passes away he wanted us to scatter his ashes where he used to like going. But that’s the issue, his partner has got his ashes and havent heard off her since he passed away and she chucked all the things out the house. Where do I stand?

  500. My brother died. My niece is his next of kin. He lived with his girlfriend and she won’t let my niece have any of my brothers possessions. He rented his property with his girlfriend and she now holds the tenancy agreement. How can my niece get my brothers possessions? What do we need to do?

  501. I have a credit card that went to collections. I paid it off over time in full even after they offered me to pay at lower amount – interest. On my credit report it shows negatively, I did all I could to get it off  but shows the failure to pay originally … I paid it in full and feeling like I’m stuck with the negativity on my report despite my efforts to pay all that I owed. All loans I applied for was turned down, to whole situation got worse when I wanted to buy a house and I was still not approved all due to my credit history. I was so furious and wanted to get solution to this luckily for me I got a solution when I contact tom.lawrence114 at g mail com after I watched a Youtube video and how he had helped people got out of credit issues. He explained the whole process and in few days he helped me removed every collections, negative items on my credit history What amazes me was how fast he got me out of this mess and got approved of the house afterwards. I’m having the best and comfort of my life thanks Tom
